Colorado sales tax debt: what the Department of Revenue can do and your options
Last updated · Reviewed for accuracy against IRS.gov guidance
Colorado's state sales tax is 2.9%, administered by the Colorado Department of Revenue, which also collects many county, special-district and statutory-city taxes. But home-rule cities such as Denver can collect their own sales tax separately, so one business can owe several different agencies at once.

Who collects Colorado sales tax
The Colorado Department of Revenue administers state sales tax at 2.9% — among the lowest state rates in the country. The Department also collects many county, statutory-city and special-district taxes, but self-collecting home-rule cities administer their own sales tax with their own returns, audits and collection.
Why Colorado balances are split
A Colorado seller behind on sales tax may owe the Department of Revenue for state and state-collected local tax and one or more home-rule cities separately. Each has its own notices and payment arrangements. List every jurisdiction on your notices before you call anyone — settling with the state doesn't touch a home-rule city balance. The state's Sales and Use Tax System (SUTS) lets businesses file for the state and participating home-rule cities in one place, but not every city participates.
Personal liability
Many states let the revenue agency assess owners and officers personally for sales tax a business collected but didn't remit. We haven't confirmed Colorado's specific rule on an official the Department of Revenue page, so we won't describe it here. If you were an owner, officer or bookkeeper with authority to pay bills, ask the Department of Revenue directly whether a responsible-person assessment applies — and read the federal Trust Fund Recovery Penalty guide if payroll taxes are also behind.
