New Mexico sales tax debt: what TRD can do and your options

Free business tax relief assessment — about 2 minutes, no contact info needed
Quick answer

New Mexico has a gross receipts tax (GRT) rather than a sales tax. It's imposed on businesses for the privilege of doing business, administered by the Taxation and Revenue Department (TRD) at a 4.875% state rate plus local increments. Because GRT applies to most services and is the seller's own tax, it's owed even if customers weren't charged.

Who collects New Mexico sales tax

The New Mexico Taxation and Revenue Department (TRD) administers gross receipts tax (GRT). The state rate is 4.875%. Counties and municipalities add local increments, and TRD publishes semi-annual rate schedules by location code.

A tax on the business, including services

GRT is imposed on persons doing business in New Mexico and measured by gross receipts, including receipts from most services. The business may pass it to customers, but the liability belongs to the business. Since 2021 most receipts are sourced to the location where the good or service is delivered, so the right local rate depends on the customer's location.

Personal liability

Many states let the revenue agency assess owners and officers personally for sales tax a business collected but didn't remit. We haven't confirmed New Mexico's specific rule on an official TRD page, so we won't describe it here. If you were an owner, officer or bookkeeper with authority to pay bills, ask TRD directly whether a responsible-person assessment applies — and read the federal Trust Fund Recovery Penalty guide if payroll taxes are also behind.

Disputes and next steps

Every TRD assessment notice states how and by when to dispute it. We haven't summarized New Mexico's appeal stages here because we couldn't confirm them on an official page — use the deadline printed on your notice, which is usually short.

Frequently asked questions

How do New Mexico businesses avoid GRT on sales for resale?

+

The buyer gives the seller a nontaxable transaction certificate (NTTC), which lets the seller deduct the receipt. Missing NTTCs are a common reason audits disallow deductions and assess GRT on sales the business thought were exempt.

Is New Mexico GRT the same as sales tax?

+

No. GRT is imposed on the business's gross receipts for the privilege of doing business, though businesses often pass it on.

What is New Mexico's state GRT rate?

+

4.875%, plus local increments that vary by location.

Do services owe New Mexico GRT?

+

Most do. GRT applies broadly to receipts from services as well as goods.

Does closing the business end New Mexico sales tax debt?

+

No. Closing stops new liability, but assessed tax, penalties and interest remain, and states often pursue the people responsible for collected-but-unremitted tax.

Where do I start if I'm behind on New Mexico sales tax?

+

File every missing return so TRD can replace any estimated bill with real figures, pay the current period, then contact TRD about the older balance.
