Since South Dakota v. Wayfair (2018), states can require you to collect sales tax once your sales into the state pass a threshold. Enter your sales and transactions into each state with that state's published threshold to see where you may have economic nexus. Thresholds aren't prefilled — each state sets its own.

In South Dakota v. Wayfair the Court upheld a law using $100,000 in sales or 200 transactions. States have since set and changed their own thresholds; the Multistate Tax Commission and each state agency publish the current rules.

What is economic nexus?
+
A state's rule that out-of-state sellers must collect its sales tax once their sales into the state pass a threshold, even with no physical presence. The Supreme Court allowed this in South Dakota v. Wayfair (2018).
Are thresholds the same in every state?
+
No. Dollar amounts, whether a transaction count applies, which sales count and the measuring period all vary by state. That's why this tool asks you to enter each state's threshold.
Do marketplace sales count?
+
Some states count sales made through marketplaces toward your threshold even though the marketplace collects the tax; others exclude them.
What if I've already passed a threshold?
+
You may owe tax for past sales. Voluntary disclosure is often the safest way to resolve it before the state contacts you.
Does physical presence still create nexus?
+
Yes. Employees, inventory or property in a state can create nexus regardless of sales volume.
